Dutch Forwarding
Conditions.
All our work is done under the Dutch Forwarding Conditions, latest version. They contain a limitation of liability and an arbitration clause.
Which conditions apply
On all our activities the Dutch Forwarding Conditions apply, in their latest version, filed by FENEX with the registries of the District Courts in the Netherlands. In Dutch they are the Nederlandse Expeditievoorwaarden, also known as the FENEX conditions.
They apply to every quotation, assignment and agreement, and they take precedence over any purchase or procurement conditions of the other party. We expressly reject the application of those.
Two clauses we are drawing to your attention
Liability is limited. The Dutch Forwarding Conditions cap what we can be held liable for, both per assignment and by category of loss. If the value of your cargo means that cap is not enough, tell us before the shipment moves and we will arrange cargo insurance. We do not insure cargo unless you ask us to in writing.
Disputes go to arbitration. The conditions contain an arbitration clause, and disputes are settled under it rather than before the ordinary civil courts.
Neither of these is unusual in this trade, but both change your position, which is why they are on this page rather than only in the small print.
Getting the full text
We send a copy free of charge on request. Ask sales@sneedglobalforwarding.com and you will have it the same day. The conditions are also published by the trade association, in Dutch and in English, and are filed with the court registries named above.
Acting as your forwarder, not as your carrier
As a forwarder we arrange transport. Unless we have agreed otherwise in writing, we do not carry the goods ourselves, and the relationship between you and the carrier who does is governed by that carrier’s own regime: CMR by road, the bill of lading and the Hague-Visby Rules by sea, the Montreal Convention by air. Which one applies to your shipment depends on how it moves, and we will tell you if you ask.
Quotations
A quotation is based on the details you give us (route, weight, dimensions, commodity and timing) and on rates, surcharges and exchange rates as they stand on the day. If any of those change before the booking is confirmed, so can the price, and we will tell you before we act on it rather than after.
